H-1 B Holder Starting a Corporation

A good idea is the starting point for beginning a company. My journey started here with just a good idea and nothing much concrete. Moreover I was a foreigner working in this country on an H-1 B visa for a software firm.

To make my idea work I had to consider other aspects of entrepreneurship that

include finance, marketing, facilities, employees, legal issues etc.

Then started my research to explore the available avenues for starting a company. It took two and a half years to gain an insight of the basic principles underlying the starting of a corporation by a H-1B holder.

Here are some of my findings that can assist an H1B holder intending to start a company.

Consider the options in starting a business

Prior to starting a new business or any new venture certain issues need to be considered. Some such issues are

1) Type of legal entity (i.e. corporation, LLC, LLP, Limited partnership, General partnerships etc.)
2) Location where the business would be established as the state law governs certain legal aspects in dealing with the venture.

The other aspects to be considered are:

  • Kind of service or product offered
  • Taxation issues
  • Applicable immigration laws
  • Administrative issues etc.
